One of the first questions that people ask when they are curious about magnet fishing is “is it legal to magnet fish?”. Think about it, you need a license to go fishing in most if not all States and if you do not have one you could end up with a huge fine. So is Magnet fishing any different? Is there a law stopping magnet fishing in any of the US States?

Well below I have compiled a table containing all 50 US states in alphabetical order and if it is legal to magnet fish there. Next to that I have written notes about the current situation as well.

Is magnet fishing legal in the US?

Is magnet fishing legal in the US? Currently magnet fishing is legal in all 50 US states. Please check for any local bylaws before you go magnet fishing in the US and make sure that you seek the landowners permission before entering their property.

  1. Thank you to Richard Atkinson for providing this update on the magnet fishing laws of South Carolina.

    It is illegal to magnet fish in South Carolina. It is not specifically stated in a law. However, SC has specific laws about recovering artifacts and fossils from SC waterways which includes out to 3 miles on the SC coast. You must have a Hobby License to remove artifacts and fossils from SC waterways. You are allowed to collect up to ten per day and you are awarded sole ownership of the items you have recovered. You must submit quarterly reports of your finds and they have 60 days to review the reports and may request photos or drawings of some items. They do not take the items from you, but may request that you take one of their divers to the recovery site for review.

    The Hobby License is required for all underwater recovery and it is specifically stated that it does NOT cover recovery of artifacts or fossils from the water from land. The regulations further state that NO mechanical devices and/or tools are allowed. Additionally, all recovered items must be visually inspected prior to bringing to the surface. No indiscriminate recovery techniques are allowed (magnet fishing is considered indiscriminate).

  2. Thanks. Just trying to keep people out of trouble in SC. On one hand it seems petty and unfair, but I’ve been told by one of the State archeologists that an archeological site was destroyed by someone magnet fishing. On the other hand, I feel that SC is being more than fair in offering the Hobby License and allowing the licensee to actually keep and being awarded sole ownership of historical artifacts and fossils which have been obtained legally. I can’t think of another state that really allows that much freedom to legally recover artifacts and fossils from state waterways and grants you ownership rather than confiscating them. This program also helps identify currently unknown archeological sites for the state.
